New York State Tax Credit Bill Targets 180 SoHo Commercial Properties

The New York State Legislature passed the Commercial Lease Tax Credit Bill on June 25. The law alters how local assessors calculate property taxes on retail leases in designated historic districts. It applies to addresses between Canal Street and Houston Street west of Broadway.
State lawmakers completed the 2026 session with several measures addressing commercial vacancies recorded in the Department of Finance 2025 annual report. That report listed 312 vacant ground-floor spaces in lower Manhattan. The new credit responds to lease renewal data showing average asking rents of $142 per square foot in SoHo in the first quarter of 2026.
Changes for Property Owners and Tenants
Under the legislation, qualifying landlords can receive a credit equal to 12 percent of the difference between current and 2024 base-year rents. The credit applies only to leases signed or renewed after January 1, 2027. Local advocates note that the credit calculation uses the same methodology already applied in the 2024 East Village pilot program administered by the Department of Finance.
Residents who operate or work at the 180 affected addresses will see the credit reflected in monthly common-area charges and lease escalations. The bill text states that building owners must file annual compliance statements with the Department of Finance by March 15 each year. Failure to file results in loss of the credit for that tax year.
Next Steps for Implementation
The Department of Finance will issue application forms by October 2026. The government says the first credits will appear on the 2027-2028 tax bills mailed in July 2027. Policy analysts say the program draws on the same $4.8 million appropriation line item used for the 2025 commercial corridor grants listed in the adopted state budget.
Community board 2 scheduled a public information session for July 22 at the SoHo neighborhood center on Broome Street. The session will review the filing process and the required documentation for both landlords and leaseholders.
