New York State adopted amended SEQR regulations that take effect on June 12, 2026, and will apply to environmental reviews for projects in DUMBO. The changes update the procedures under the State Environmental Quality Review Act that local and state agencies must follow when assessing proposed development and cleanup actions.
The timing places the revised rules into operation for any new applications submitted after the June date. DUMBO already operates under a Special Mixed Use District zoning designation established in 2009 that previously completed SEQRA and CEQR review and received a Negative Declaration. Waterfront Regulations from the city Zoning Resolution continue to require open space and formal public access on affected properties through special ministerial procedures.
Ongoing Brownfield Site Work
Two large brownfield sites in DUMBO remain under the New York State DEC Brownfield Cleanup Program. Site investigations and proposed remedial plans are in progress at both locations. These steps occur under the existing program framework and will intersect with the amended SEQR process once the June 2026 date arrives for any additional review requirements.
Completed Infrastructure Changes
A $108 million infrastructure project finished in late 2025 converted combined sewers to sanitary sewers across parts of DUMBO. The work targeted reductions in harbor pollution and improvements to stormwater drainage. Residents have already seen the physical completion of this conversion, which addressed one set of environmental conditions ahead of the new SEQR rules.
Future project reviews under the amended regulations will determine how additional proposals align with the Special Mixed Use District rules and waterfront requirements. The government expects the updated SEQR process to shape the documentation and public notice steps for those submissions. Site investigations at the brownfield locations continue in the interim, with remedial plans advancing under current DEC oversight.
